Sales contract

Sales, orders and contracts negotiated through our agents or representatives only become final once they have been accepted and confirmed in writing by LE JACQUARD FRANÇAIS.

Product characteristics

The products offered are those featured in the LE JACQUARD FRANÇAIS catalogue.

These products are offered while stocks last. If products are unavailable, LE JACQUARD FRANÇAIS undertakes to inform the customer. LE JACQUARD FRANÇAIS does not guarantee that products will remain on sale for any given period.

Each product offered is described and presented as accurately as possible by LE JACQUARD FRANÇAIS. Catalogue photographs are as faithful as possible but cannot guarantee a perfect match with the product sold, particularly with regard to colours.

Prices

Prices shown in the catalogue are inclusive of tax, in Euros, UK Pounds, Swiss Francs or US Dollars depending on the destination, and include VAT according to the tax rules in force in the geographical area of sale. Any change in the rate may be passed on in the price of the products.

Le Jacquard Français reserves the right to change its prices at any time, it being understood that the price shown in the catalogue on the day of the order will be the only one applicable to the buyer.

The prices shown do not include transport and delivery costs or customs duties (except for Canada and the United States), provided that delivery takes place in the geographical areas set out below.

Geographical area

Online sales of the products presented on the site are reserved for buyers requesting delivery to mainland France, Corsica and all countries with open access to the site.

Le Jacquard Français reserves the right to grant or withdraw access to the site, by country, at any time and at its sole discretion.

Ordering

To place an order on the site, the customer must be at least 18 years old and have legal capacity.

To order a product on the site, the customer must create an account. When opening the account, the customer undertakes to provide Le Jacquard Français with accurate information and to inform the company of any change to that information. To open an account in the United States, the customer must provide their “tax number”.

Confirmation of the order constitutes acceptance of these terms of sale. All data provided and the recorded confirmation shall constitute proof of the transaction. Confirmation shall constitute signature and acceptance of the operations carried out.

Le Jacquard Français will send confirmation of the registered order by e-mail and recommends that customers keep a copy (paper or digital).

In certain cases, in particular non-payment, an incorrect address or any other problem relating to the order, Le Jacquard Français reserves the right to block the buyer’s order until the problem is resolved.

Payment terms

Payment is due at the time of order. By providing their bank details, the customer authorises Le Jacquard Français to carry out a transaction.

Purchases are paid for either via PayPal or via the secure platform of our payment provider ADYEN (www.adyen.com). In accordance with the standards in force for payment services, the information provided by the buyer and transmitted to ADYEN cannot be intercepted by a third party. The information entered by the buyer is encrypted and will not travel in clear text over the Internet.

The buyer’s account will only be debited when the available products are shipped, and only for the amount of the products sent.

An invoice may be sent to the buyer by e-mail on request. On simple request, a paper invoice showing VAT will also be sent to them.

Delivery

All purchases must be paid for before delivery. Deliveries are made to the address of your choice, shown on the order form, which may only be within the agreed geographical area.

Please note that you must provide us with a precise, easily accessible delivery address, a telephone number for the recipient (preferably a mobile), a delivery time slot and any other information necessary for access.

Delivery times are given for information only and delays cannot give rise to damages payable by LE JACQUARD FRANÇAIS or to cancellation of the sale.

Any order placed on our online store and delivered outside France may be subject to taxes and customs duties imposed when the parcel arrives at its destination. These customs duties and taxes relating to the delivery of a product are payable by the buyer and are their responsibility. Le Jacquard Français is not required to check or inform the buyer of the applicable customs duties and taxes. To find out about them, the buyer is advised to contact the competent authorities in their country.

A confirmation e-mail will be sent to you when your order is shipped.

Shipping costs

Right of withdrawal

In accordance with articles L.221-18 et seq. of the French Consumer Code, the buyer has a period in which to exercise their right of withdrawal without having to give any reason or pay any penalty. The period is 14 days and runs from the date the products are received.

Returns made under the right of withdrawal are at the customer’s expense and will only be accepted if the products are returned in their original condition, i.e. unused, unwashed, unstained and undamaged. Any item returned incomplete, damaged or soiled cannot be refunded. All products may be refunded except those made to the consumer’s specifications or clearly personalised (made-to-measure).

To exercise their right of withdrawal, the buyer must notify us of their decision to withdraw from this contract by means of an unambiguous statement, either via the returns page provided on this site, or by letter sent by post (Le Jacquard Français – 45 boulevard Kelsch – 88400 Gérardmer, France), or by fax on +33 (0)3 29 60 05 92, or by e-mail to service.client@le-jacquard-francais.com, or by telephone on +33 (0)3 29 60 61 99, within the time limits described above. You may use the withdrawal form on the Service-Public.fr website.

The product(s) must be returned sufficiently protected to avoid damage during transport.

Exchanges

If the buyer wishes to make an exchange, they must request a return authorisation via the form provided on this site within 15 days of the date the parcel was received or collected. Le Jacquard Français will reply with the procedure to follow for returning the product.

Products that have been personalised at the buyer’s request (made-to-measure, embroidery) or that have been used by the buyer cannot be exchanged.

Warranty

All products supplied by Le Jacquard Français benefit from the legal guarantee of conformity (article L217-4 et seq. of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), allowing the buyer to return defective products delivered.

In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back and replace it.

All claims or replacement requests must be made via our contact page within twenty-four months of delivery. Le Jacquard Français will reply with the procedure to follow for returning the product.

In the case of the return of a defective item, shipping costs will be free of charge or refunded to the buyer.

Personal data

The personal data collected is processed by Le Jacquard Français – 45 boulevard Kelsch – 88400 Gérardmer, France, the data controller.

This data is collected for the management of your customer account and will be used to inform you of our company’s commercial news. It is intended for Le Jacquard Français and for the external service providers used by the data controller. It will be kept for 3 years from the last contact.

In accordance with the applicable personal data regulations, you have the right of access, rectification, objection, restriction of processing, erasure and portability of your data, which you may exercise by e-mail to service.client@le-jacquard-francais.com or by post to: Le Jacquard Français – 45 boulevard Kelsch – 88400 Gérardmer, France, stating your surname, first name and address and enclosing a copy of both sides of your identity document.

In the event of any difficulty relating to the management of your personal data, you may lodge a complaint with the data protection officer – dpo.france@elis.com – or with the CNIL or any other competent authority.

Mediation

In accordance with article L612-1 of the French Consumer Code, you may use the CMAP mediation service free of charge by contacting them either:

• via the form available on the CMAP website at www.mediateur-conso.cmap.fr,

Dispute resolution

These online terms of sale are governed by French law. For sales to consumers, failing an amicable agreement, any dispute of any kind relating hereto shall fall within the jurisdiction, at the claimant’s choice, of the courts of the place where the defendant resides or, in contractual matters, the court of the place where the products are actually delivered.

Personalisation

Embroidered items cannot be returned or refunded.

For orders including one or more embroidered items, 5 to 7 additional days must be added to the stated delivery time.

Gift card

The e-gift card is sent directly to the recipient on the date chosen. It can be used in one or several instalments for one year from the date it is sent to the recipient, on our site only.

It is used by entering the code received by e-mail and can be topped up with another means of payment. No change will be given.

Once the gift card has been sent to its recipient, gift cards can no longer be exchanged or refunded, even partially (in particular in the event of loss, theft or expiry).

If a product bought with a gift card is refunded, you will receive a new gift card for an amount equal to that refund. It is not eligible for a discount on the order.

Promotions

Birthday promo code: offer valid on the item of your choice, excluding items already on promotion, on the le-jacquard-francais.com site or in our three Le Jacquard Français boutiques.
